My Eco Store - Terms and Conditions

Please read these terms and conditions of sale carefully before placing an order for any goods. A copy will be emailed with your Order Confirmation.


1. Definitions used in our Terms and Conditions

In these terms and conditions "we" and "us" mean My Eco Store a trading name of Eco Promotions Limited, and "you" means you the customer. For your ease of reference these defined terms and others are listed together at the end of the terms and conditions. These terms and conditions together with the Order Confirmation we will send to you on acceptance by us of an Order and our current website prices and our Privacy Policy constitute the Contract between us for the supply of the Products.

No other terms and conditions shall apply even if submitted in a later document from you. The Contract cannot be varied unless we agree to vary it in writing or by email.


2. Placing Your Order

2.1 To place an Order you must be 18 years of age or over and be accessible by both telephone and email. Placing an Order constitutes your Offer to buy the Products.

2.2 You may place an Order by:

2.2.1 creating an order on-line on www.myecostore.co.uk Web Site or

2.2.2 telephoning us and verbally placing an order with us, however you must have a valid email address so that we can send an Order Confirmation to you

We will not accept Orders placed in any way other than those listed above.

2.3 When you have finished creating an Order you will be invited to "Checkout"

  • At checkout you will be shown or told a summary of your shopping basket
  • You will be asked to give contact / delivery details
  • You will be asked to choose shipping service
  • You will be shown or told a Confirmation of the total order value incl. Shipping
  • Please select preferred payment option from Credit Card on-line through Paypal, providing credit card details over the telephone, sending a cheque.
  • On confirming method of payment we will provide you with an Order Reference Number and will email a summary of your Order to you, this Order Confirmation is our Acceptance of your Offer (subject to receipt of your payment) and constitutes the contract between us and you for the supply of Products on these terms and conditions. We may or may not accept your Offer at our discretion.


2.4 Whilst we will make every effort to supply you with the Products listed on the Order Confirmation, there may be occasions where we are unable to supply these Products because, for example, (i) such Products are no longer being manufactured or available or (ii) we are unable to source relevant components or (iii) we do not deliver to your area; or (iv) one or more of the Products you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

In such circumstances we will contact you to inform you and may suggest alternative Products that you might wish to purchase. If you do not accept our suggestions then we will cancel your Order in relation to those Products we cannot supply and repay you any money that you may have paid to us in respect of those Products.

Repayment of such monies will be the extent of our liability to you if we are unable to deliver to you the Products you have ordered.

2.5 Information contained in our advertising, brochures, other written materials, on our web sites or given to you by our agents or employees constitutes an invitation to treat. No such information constitutes an offer by us to supply any products, nor does it constitute any representations or warranties in relation to any Products.


3. Prices

3.1 The price for the Products will be the price listed on the Web Site and confirmed on your Order Confirmation at Checkout.

3.2 VAT is included in all prices shown on the Web Site and your Order Confirmation, applied to all goods and services provided at the applicable rate.

3.3 Delivery costs, where applicable, are applied to the Order upon selection of the delivery service needed and will be clearly shown on the Order Confirmation at checkout.


4. Payment

4.1 You will pay for your Products following Checkout, depending on the payment option selected, as follows

  • Make Credit Card Payment on-line
  • This will take you to the PayPal secure on-line server for payment
  • On supplying credit card details to PayPal, PayPal will confirm your Order and successful payment
  • PayPal will instruct our picking department to proceed with your Order

  • Make a Credit Card Payment Verbally, the Web Site will provide an Order Number for you to refer to our telephone sales team
  • On successful completion of payment by credit card your Order Number will be sent to our picking department to proceed with your Order

  • Making a Cheque Payment, the Web Site will provide an Order Number for you to refer to on your cheque, this can be posted to our offices
  • Please note despatch of Products paid by cheque will be delayed until cheques have cleared with the bank

4.2 My Eco Store only accepts payment in Pounds Sterling.


5. Delivery of Your Products

5.1 At present My Eco Store only deliver to UK mainland addresses

5.2 Title to and risk of loss in your Products will pass to you on delivery of the Products

5.3 Once your Order has been despatched we will send you a confirmation of shipment by e-mail

5.4 Depending how much your Order weighs, your Order will go by Royal Mail Recorded Second-Class, Royal Mail Recorded First Class, Royal Mail Special Delivery, or by courier, in all cases a signature will be required when you receive your parcel.

Couriers deliver Monday to Friday, Royal Mail deliver Monday to Saturday.


6. Right for you to cancel your contract

6.1 You may cancel your contract with us for the Products you order at any time up to the end of the seventh working day from the date you receive the ordered Products. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.

6.2 To cancel your contract you must notify by e-mail to: returns@myecostore.co.uk

6.3 If you have received the Products before you cancel your contract then you must send the Products back to our contact address in accordance with clause 6.6 at your own cost and risk. If you cancel your contract but we have already processed the Products for delivery you must not unpack the Products when they are received by you and you must send the Products back to us at our contact address at your own cost and risk as soon as possible.

6.4 Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your Order PROVIDED THAT the Products in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the Products delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the Products from the amount to be re-credited to you.

6.5 If you are returning goods that were supplied by us in substitution for those you originally ordered then we will pay the cost of returning them.

6.6 Return Instructions:

(i) Please contact us via email, returns@myecostore.co.uk, quoting your original Order Number. We will provide a Returns Number.
(ii). Enclose all accessories, in box warranties and other material supplied unless informed otherwise.
(iii). Use all packaging that was originally supplied, unless informed otherwise.
(iv). Ensure the following returns address and the Returns Number are clearly displayed on the packaging used to return the goods:

(v). Seal and package the returning products securely.
(vi) We cannot accept responsibility for returned items which do not reach us. Therefore we recommend that you send returns via the Post Office, by Recorded or Special Delivery, retaining your proof of postage.

Following these steps will help ensure the Product(s) arrive at the correct destination and in good condition within a timely fashion. Please note that you have a statutory duty to take reasonable care of the Product(s) and if you fail to do so we may have a right of action against you.


7. Warranty Claims

7.1 If a Product becomes faulty and you believe that you are entitled to a replacement or repair please follow the below instructions according to the type of Product.

7.2 All My Eco Store branded product:
Carry a 3-month limited warranty against defects in materials and workmanship. Such a limited warranty covers My Eco Store branded products (as defined in clause 15) only; it does not cover any other Products. You should refer to the relevant warranties which may apply to your product.

7.3 Non My Eco Store branded/Third-party Products
For non My Eco Store branded Products (including non My Eco Store branded products contained in product bundles or promotions), all warranty claims, where relevant, are to be made in accordance with the terms and conditions of any standard manufacturer's warranty which may be included with the Products purchased. In relation to any existing manufacturer's warranty, any warranty claims should first be made either directly to the manufacturer or to us by phone.

7.4 For claims under clause 7.2 or 7.3 please contact either the manufacturer direct or My Eco Store by email returns@myecostore.co.uk informing us of the Order Number, product and the problem. We will contact the relevant manufacturer on your behalf, if the products are to be returned please return in accordance with clause 6.6.

7.5 Please note that while the Product(s) remain in your possession you are under a duty to ensure that the Product(s) are kept safe and secure.

7.6 IF YOU ARE A CONSUMER, THE WARRANTIES REFERRED TO ABOVE ARE IN ADDITION TO AND DO NOT AFFECT YOUR STATUTORY RIGHTS.


8. Our Liability

8.1 These terms and conditions set out the full extent of our obligations and liabilities in respect of the products we supply, and there are no warranties, conditions or other terms applicable to the supply of Products or the provision of Services by us except as expressly stated in the Contract.

8.2 If the Products we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.

8.3 If you do not receive Products ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.

If you notify a problem to us under clause 8.2 or 8.3, our only obligation will be, at your option:
(i) to make good any shortage or non-delivery;
(ii) to replace or repair any Products that are damaged or defective; or
(iii) to refund to you the amount paid by you for the Products in question in whatever way we choose.

8.4 Any warranty, condition or other term arising out of or in connection with the supply of Products and/or the provision of Services which might otherwise be implied into or incorporated in the Contract by statute, common law, laws applicable in the country where you purchased the Products or Services or otherwise (including without limitation any implied term as to quality, fitness for purpose, reasonable care and skill) is hereby expressly excluded to the maximum extent permitted by law. In particular, we will not be responsible for ensuring that the Products are suitable for your purposes.

8.5 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of our supply of goods to you and we shall have no liability to pay any money to you by way of compensation other than any payment due to you under these terms.

8.6 Our maximum aggregate liability under the Contract whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) and/or Services in question, and return costs where applicable under clause 6.6.

8.7 We are providing the Web Site on an 'as is' basis and we make no representations or warranties of any kind with respect to the Web Site or its contents and disclaim all such representations and warranties. In addition, we make no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published in the Web Site. The information contained in the Web Site may contain technical inaccuracies or typographical errors. All liability of us howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

8.8 Neither us nor any of our directors, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of the Web Site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

8.9 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

10. Residency

This site is targeted at United Kingdom mainland residents only. If you are not a mainland resident of the United Kingdom DO NOT USE THIS SITE. In listing your place of residence and delivery address in our order form, you are representing to us that you are a resident of mainland United Kingdom. This is a representation on which we rely prior to accepting your Offer to purchase our advertised goods and services.


11. Data Protection

By placing your Order, you agree and understand that we may store, process and use data collected from your Order Form or telephone Order for the purposes of processing your Order. Please also see our Privacy Policy.


12. Circumstances beyond our reasonable control

We will make every effort to perform our obligations under the Contract. However, we cannot be held responsible for delays or failure to perform if such delay or failure is caused by any circumstances beyond our reasonable control. In the event of a delay, we will perform our obligations as soon as reasonably possible.


13. Governing Law and Jurisdiction

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.


14. General

14.1 Neither our failure or your failure to enforce any term of the Contract constitutes a waiver of such term. Such failure shall in no way affect the right later to enforce such term.

14.2 If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

14.3 Except for our affiliates, directors, employees or representatives, a person who is not a party to this Contract has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

14.4 The Contract sets out the whole of our agreement relating to the supply of goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.


15. Defined Terms

15.1 In these terms and conditions:

"We" and "us" mean My Eco Store a trading name of Eco Promotions Ltd

"You" means you the customer

"Contract" means these terms and conditions together with your Order Confirmation, our current website prices and our Privacy Policy

"Consumer" means a customer who purchases Products

"My Eco Store branded product" means any Product branded with a My Eco Store logo

"Non My Eco Store branded/Third-party Products" means all product found on the Web Site which is manufactured / branded by a third party supplier

"Order" means an order placed by you in accordance with these terms and conditions

"Order Confirmation" means the order summary issued by us via email to you summarising the contents of your Order

"Order Form" means the electronic order form on the Web Site

"Order Number" means the order number issued by us to you once completing your Order and selecting method of payment

"Product" means any product listed on the Web Site which we agree to supply to you on these terms and conditions

"Return Authorisation Documentation" means the documentation issued by us to you for the return of Products

"Web Site" means our web site for customers in the mainland United Kingdom, the web address of which is http://www.myecostore.co.uk

"Working Day" means any day other than a Saturday, a Sunday or a public holiday in the United Kingdom
